Terms & Conditions of Sale

By placing a bid or registering as a bidder with Golden Eagle Auctions (“GEA” or “Auctioneer”), you agree to be bound by the following terms and conditions. Please read them carefully before participating. Please know your state’s firearms and ammunition shipping laws prior to bidding.

1. General Terms

The following terms and conditions of sale make up the entire terms and conditions on which items listed in Golden Eagle Auctions (known hereafter as “GEA” or “Auctioneer”) catalog. Any person who participates by bidding in this auction, accepts a bidder number (each a “Bidder”) agrees and accepts these terms and conditions of sale and agrees to be bound by the same.

Additional terms may be posted or announced from the auction block, which shall also be binding on Bidder. All announcements made by Auctioneer shall supersede any printed material.

In the event that a bid is executed by another person on behalf of Bidder — whether in person by an agent, absentee bid, telephone bid, or via the internet — the Bidder agrees that Bidder is responsible and guarantees payment for any successful bid.

All winning bids are final and constitute a binding contract. NONE OF Golden Eagle Auctions, ITS AFFILIATES, OR EMPLOYEES ARE RESPONSIBLE FOR ANY ERRORS OF A BIDDER INCLUDING BUT NOT LIMITED TO THE BIDDER BIDDING ON THE WRONG LOT. All items are sold AS IS, WHERE IS. ALL SALES ARE FINAL — NO REFUNDS OR EXCHANGES.

GEA does not guarantee or make warranties on any lot sold. Descriptions in the catalog are opinion and written as an aid to prospective Bidders and/or buyers. GEA acknowledges that there may be errors in what is written. Auctioneer recommends that each bidder personally view and inspect any item they intend to bid on or contact Auctioneer prior to bidding with questions. Statements referencing an item’s condition are opinions, not statements of fact or guarantees. Items offered for sale as described in the catalog, on our website or any advertisement, or elsewhere as to authorship, period, culture, source, origin, measurement, quality, rarity, provenance, importance, exhibition, or physical condition are qualified statements of opinion and not representations or warranties. All federal, state, and local regulations apply to firearms sales and transfers.

2. Buyer’s Premium

Every lot sold, regardless of final price, is subject to a 15% buyer’s premium, which must be paid by the Bidder.

3. Sales Tax

A 7% sales tax will be collected for all in-person pickups and shipping of items to a Florida address. Buyers residing outside of the state of Florida are responsible for remitting the sales tax to their appropriate local agency. Dealers purchasing must register their State of Florida tax exemption form along with FFL prior to the sale. If you provide a valid copy of your State of Florida tax exemption certificate within 5 business days after the auction, the sales tax will be refunded to you.

4. Participation Requirements

A valid credit card is required for bidding approval.

5. Payment Options & Instructions

Winning bidders will receive an email from info@goldeneagleauctions.com to the email given upon registration within 72 hours after the auction closes. This email will contain an invoice and payment link for their winning bids. Payment must be completed within 48 hours of receiving the invoice, unless other arrangements have been made by Bidder with Golden Eagle Auctions prior to the start of the auction or the Bidder is picking up in person.

Accepted payment methods: Cash, Check, Cashier’s Check, Wire Transfer ($25 fee applies), Visa, MasterCard, Discover. A 3% surcharge applies to all credit card transactions. Buyers using wire transfer are recommended to contact Golden Eagle Auctions to confirm wire instructions prior to making any such transfer.

Bidders picking up in person may pay via cash, check, cashier’s check, or credit card at the time of pickup.

6. Chargeback Policy

Credit card chargebacks will not be accepted under any circumstances. This includes, but is not limited to, disputes arising from buyer’s remorse, the Bidder’s inability to legally receive or possess purchased items due to state or local laws, failure to inspect items prior to bidding, or disagreements regarding item condition or description. Any Bidder who initiates a chargeback agrees that GEA may pursue collection of all outstanding amounts, including the hammer price, buyer’s premium, applicable taxes, fees, and any costs incurred in connection with the chargeback dispute, including but not limited to collection agency fees, attorney’s fees, and court costs.

7. Shipping & Handling

All winning bidders requiring shipping are responsible for the cost of shipping. A flat rate of $30.00 per handgun and $40.00 per long gun will be added to your invoice automatically for all buyers outside the state of Florida. Florida buyers should notify GEA if they will require shipping or will be picking up in person.

Following the auction, you must email FFL@goldeneagleauctions.com to provide a copy of the FFL the item(s) are to be shipped to.

Items will not be shipped until full payment has been received and valid FFL information has been provided.

8. FFL Submission Requirement

Winning bidders requiring shipping must submit a copy of their receiving FFL to FFL@goldeneagleauctions.com within 30 days of the auction’s conclusion. If FFL information has not been received within 30 days, GEA will issue one courtesy reminder. The Bidder then has 30 days from the date of the reminder to either:

1. Submit their FFL information, or

2. Notify GEA that they are unable to receive the item(s) and execute a consignment agreement with GEA, under which GEA may, at its sole discretion, relist the item(s) in a subsequent auction or offer them for private sale. Upon successful resale, the proceeds — less a 20% commission and any applicable fees — will be remitted to the original winning Bidder, provided their original invoice has been paid in full.

If the Bidder fails to submit FFL information, notify GEA, or execute a consignment agreement within 60 days of the auction’s conclusion, the item(s) will be considered abandoned and handled in accordance with the Abandoned Items policy outlined herein.

9. Checkout & Firearm Transfers

Items purchased will not be released until full payment is received, verified, and approved. All federal, state, and local regulations apply to firearms sales and transfers.

In-person firearm transfers will take place at Golden Eagle Auctions in Sanford, FL BY APPOINTMENT ONLY.

All in-person firearms transfers are subject to a $5.00 background check fee (excluding black powder firearms and pre-1898 antiques). A 3-day waiting period, beginning from the date of payment, applies to all handguns and long guns unless you provide a valid Florida concealed carry permit.

10. Bidder Responsibility — State & Local Firearms Laws

It is the sole responsibility of the Bidder to know and understand all federal, state, and local laws and regulations governing the purchase, possession, and transfer of firearms and ammunition in their jurisdiction prior to placing a bid. In the event that a winning Bidder is unable to legally receive or possess a firearm due to federal, state, or local restrictions, this shall not constitute grounds for a refund, chargeback, or cancellation of the sale. GEA and its affiliates bear no responsibility for a Bidder’s failure to verify the legality of their purchase.

In such cases, the winning Bidder must notify GEA within 60 days of the auction’s conclusion and execute a consignment agreement. GEA will then, at its sole discretion, relist the item(s) in a subsequent auction or offer them for private sale. The original winning Bidder will receive the resale proceeds, less a 20% commission and any applicable fees, provided their original invoice has been paid in full. If the Bidder fails to notify GEA or execute a consignment agreement within 60 days of the auction’s conclusion, the item(s) will be considered abandoned and handled in accordance with the Abandoned Items policy outlined herein.

11. Disputes & Reserves

Auctioneer can, at his or her sole option, refuse any bid. The highest qualified Bidder recognized by the Auctioneer shall be the Purchaser. In the event of any dispute between Bidders at auction, the Auctioneer may, at its sole discretion, reopen the lot. The Auctioneer’s decision and declaration of the winning Bidder shall be final and binding upon all Bidders. GEA’s records will be deemed conclusive in all respects in the event there is any dispute after the sale.

Unless otherwise indicated, all lots are subject to a reserve (the confidential minimum price below which the lot will not be sold). If a lot is offered with a reserve, the Auctioneer may implement that reserve by bidding on behalf of the consignor. Once bidding is opened, the Auctioneer may bid on behalf of the consignor to reach the reserve price. Consignors are not allowed to bid on their own lots.

12. Removal & Abandoned Items

Removal: All personal property/merchandise must be paid for in full before removal. All property must be removed within 7 days. If merchandise cannot be removed, arrangements with auction staff must be made for storage or shipping. The buyer is responsible for all storage and shipping costs.

Abandoned Items: Any items purchased and not removed or shipped within 60 days of the auction’s conclusion are considered abandoned by the purchaser. This includes, but is not limited to, failure to submit required FFL information or failure to execute a consignment agreement within the timeframes set forth in the FFL Submission Requirement and Bidder Responsibility — State & Local Firearms Laws sections of these terms. All abandoned items will be sold at fair market value during a subsequent auction or by private sale at GEA’s sole discretion. No proceeds from the sale of abandoned items will be returned to the original purchaser.

13. Default & Forfeiture

Failure to make required payments or effect removal of property/merchandise within the time and manner specified shall be deemed forfeiture of any right, title, and interest Bidder may have acquired, and the property/merchandise shall revert and repossess to Golden Eagle Auctions.

In the event of default, GEA reserves the right to pursue collection of any outstanding balance, including but not limited to the hammer price, buyer’s premium, applicable taxes, and any fees incurred.

14. Limitation of Liability & Indemnification

Bidder agrees to indemnify and hold harmless Golden Eagle Auctions, its officers, employees, and agents from any and all claims, damages, losses, or expenses arising from the Bidder’s participation in any auction, including but not limited to disputes regarding item condition, authenticity, or the Bidder’s ability to legally possess purchased items.

In no event shall GEA’s liability to any Bidder exceed the total amount paid by that Bidder for the lot(s) in question.

15. Governing Law & Jurisdiction

These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of Florida. Any disputes arising hereunder shall be resolved in the courts of Seminole County, Florida.
